The LayBy Store Terms & Conditions
When you place an order with The LayBy Store, you are agreeing to the following Terms and Conditions.
Payment start date
Your LayBy payment plan starts the day you selected when you placed your order and continues at the frequency that you selected, being either Weekly, Fortnighlty or Monthly.
Payments on Public Holidays
Where your payment is due on a public holiday than it is acceptable that you payment is made by the next working day after the public holiday. The LayBy Store is located in Newcastle NSW, therefore we observe all NSW public holidays.
Changes to your LayBy payments
In the event that you wish to skip/suspend or cancel a payment than you must give The LayBy Store at least 48 business hours to request these changes as this is not an automatic process. Failure to give this required notice will not allow changes to be made in time and your changes can not be actioned.
Missed / Failed payments
A failed payment fee of $12.50 will be charged to your account each time a scheduled payment is missed or fails to occur within your payment frequency.
Neglected Accounts/Orders/Reoccuring Payment Plans
When an order has had no activity for a period of three months, The LayBy Store reserves the right to cancel these orders and recoup any fair and reasonable costs associated with the order. Special circumstances will be considered.
Should your delivery address change, please inform us immediatley, items returned due to change of address may inccur additional costs associated with the return and re delivery of your item/s. You will receive a confirmation email with delivery details when you’ve made your final payment. Your order will arrive within 10 business days of your final payment being cleared, unless otherwise specified. While every effort is made to deliver as advised, The LayBy Store cannot accept any liability for delay due to the customer’s failure to complete customer obligations or any other reason beyond the control of The LayBy Store (and/or its staff). The LayBy Store cannot accept any liability resulting from a contracted party’s failure to deliver as advised.
We will gladly replace item/s should a product be damaged in transit and in accordance with our legal responsibilities as a merchant We are unable to accept returns for other reasons such as if you have changed your mind or have made an incorrect choice about the product and no longer wish to keep it. In the event that damage has occured in transit you must notify us with 2 business days.
If your order is cancelled, cancellation charges will apply which enable us to recover our costs.You may cancel your order at no charge if payments have not commenced.Once payments have commenced a cancellation fee will be deducted from any refund as follows:
1. Upon receipt of your first payment, a cancellation fee of $25 will be applied.
2. After that date and up to final payment 10% of the payments made to date.
3. Your order cannot be cancelled once it is fully paid.
Our Debit Provider
In order for our service to be available to you we use a secure payment partner, EzyPay. Please read the EzyPay Terms and conditions when creating your Layby. Whilst we do not charge any of our customers a setup fee or quarterly account service fees or direct deibt fees please be reminded that we do charge failed payment fees.
$1.24 cost per transaction for Debit Cards, cheaper than withdrawing money from an ATM
3.06% or $1.60 whichever is higher for Master or Visa card Transactions
6.10% or $3.03 whichever is higher for Amex or Diners card Transactions
The LayBy Store Pty Ltd do not make any profit from these charges.
